Before starting a project, we need to make sure we are on the same page so there aren't misunderstandings and to protect against fraud, so please take some time to read through these terms! Thank you.by commissioning me, you are indicating that
you've read Terms of Service and agree with them.

✦ ― Terms of Service Agreement

› By commissioning me you understand that I have a autoimmune illness that sometimes affects me really bad and performing basic tasks are hard.› I have a very bad anxiety disorder and stress very easily, which causes the illness to worsen, please give me my space. You will always be provided with many updates as I have them, and warned when I am disabled.
If you hound me too much trust me I'll let you know.› Absolutely avoid asking for updates if your commission was worked on that week and trello is updated.› I am not a student and I do freelance full time. So ETA tend to be short, and work gets slower depending on chores I have or consultations. Please keep that in mind, I am human.› I warrant that the Work will be my original work performed to the best of my ability. Artistic style is subject to minor changes as I improve and develop as an artist.› By commissioning me you confirm that you have the right to use the characters that you provide.› if you attempt to haggle my prices i will charge you extra on the spot lol.› our relationship is strictly professional, please do not try to befriend me or speak to me outside of work hours unless it's about your commission, thanks.
I was forced to implement this rule due to parasocial relationships in the past.› Any Work done or made available to the client must not be used for AI (Artificial Intelligence, Machine Learning, AI/ML Training, NFT, blockchain or any for profit platforms or purposes. Such usage is completely prohibited and may result in legal action taken.› I reserve the right to refuse to accept projects if it does not fit with my style.› By commissioning, you confirm you are at least 18 years old.› I may re-use generic emote ideas/poses or scrapped sketches for future projects if another client asks me or for YCHs.

✦ ― Contents, Yes and No

› I have the right to refuse projects and requests according to my discernment and capabilities. I have a small list on my prices about what I enjoy doing/can't do; this is basically the longer more detailed version of it.Some content that I will not be comfortable or refuse representing include:
— Discriminating/hateful themes towards race, gender, sex, sexuality, religion or any other group or individual.
— Non-consensual situations including such as minors in danger or inappropriate situations + used diapers and any fetish related to such; any form of bestiality.
— Any form of age play. Nothing against the kink, I fully support you bros 2 adults doing whatever consensual, I just have a trauma yahooo!
— Unhygienic fetishes related to urine, infections, disease, vomiting or scat.
— I absolutely REFUSE horse or horse-like penises.
— Imitation of other art styles. Just commission them instead bro.
— Cucking. Randomly yes

— Inflation (the housing prices have traumatized me)
— Over exagerated hyper. I have a limit now (shocking)
— Guns, war, anything related to that, including clothing.

✦ ― Reference images

› I must be provided a visual character reference you would like drawn.
3D models can be accepted but please give me the HEX color code for the base colors, because the model contains shading, which makes it hard for me to color pick accurately. I will refuse to correct your commission if this info isn't provided.

✦ ― Timeline & Process

› Failure to provide payment 3 times will result in you getting blacklisted. You are taking my time and someone else's slot.› Clients agree to provide all required art, references, information and assets before Work starts and during the process, or it can affect the timeline.› The completion of the Work (ONCE STARTED) requires 1 week at minimum, and may typically average 2 day to 1 weeks (for colored sketches) or 5 weeks for full shades, depending on commission type, complexity, and workload of commissions. Deadlines are not accepted as I my illness is unpredictable.› There may be 1 sketch revision for each item shown during the process, not including mistakes made by me. Revision later in the process such as after line art can only be minor or charged a fee. I will actively reach out for feedback. Multiple heavy sketch changes will be charged with a fee and discarded sketches will be sold as YCH later.› Delivery of finished Work will be through email, telegram or discord. It is up to your preference.

✦ ― Communication

› All communications must be concise and polite, unless we know each other well lol be unprofessional. We vibe in this house.› I can't work with you if you use a translator as this can make the communication process harder.› If you are having a hard time verbalizing your request, please gather image references or draw a stick figure doodle to help in your presentation. Please don't use over complicated english, despite being fluent I have ADHD and it's hard to focus. Make things simple please.› Communication will take place throughout the entire project timeline with updates and bouncing ideas. I will typically ask for feedback when I have something to show. I will personally let you know if anything is causing delays or priority shifts in the project.› I will use Trello board to track status to facilitate communications. I will typically respond quickly (less than 24 hours). You may message me at anytime and I will get back to you as soon as I can.› If you need to contact me, the fastest way is telegram, but any of the socials above are OK as well.› If you have read my TOS until now, the s3cr3t w0rd is "I am literate and actually read artist's TOS"

✦ ― Rights, Usage & Credits

Artist Rights
› I retain original copyright and ownership of the Work, which includes but may not be limited to redistributing, reproducing, advertising, displaying the Work in my websites, social media and portfolios according to my discretion. I have rights to repurpose unused process work for future projects, personal or otherwise.› I will post WIPs and the finished artwork wherever I please unless stated otherwise. Please state if your commission is private.Client Rights
› Clients are granted exclusive rights for personal use of the Work produced as agreed upon, which must not be transferred to any other parties. Personal use includes:
(ex: Social media profile pictures, signatures, layouts, themes, wallpapers, personal website display, social media posts, physical prints and products) that is not for sale or distribution to any other party.› Clients may not at any time modify, edit, change the Work without permission. You can ask me and if it's minor things I can even do it for free (such as color changes, etc).› Clients are allowed to color the sketches themselves. Another artist is not allowed to be paid to color MY work.› Clients may not claim Work as their own or anyone else’s and therefore must credit me as the Artist using my social tag/username/link (rentalgf).

✦ ― Commercial Rights

› Unless specified in the commission information or otherwise discussed and agreed upon, commercial licenses and reselling rights are not included.› Commercial means usage on streams, broadcast content, or any monetized work (i.e. including but not exclusive to: merchandise, monetized videos, music releases); and reselling rights means selling the Work to another party or another platform or on any platform.› Commercial licenses require additional charges of i.e. 100%/3x on a case-by-case basis / as listed in the commission information.

✦ ― Payments, Cancellation, Refunds

Payment
› Before starting the project, the Client pays in full upfront.
Prices are in EURO (€), and paid via Paypal.› You may send payment through paypal when Work is ready to begin. Do not send a payment without my request. I'll slap you.› By engaging on any project, once Work has started, or transactions have been made through Paypal or any payment service provider, the Client acknowledges the product and deliverables are DIGITAL and there is no physically shipped good to receive. Chargebacks are not permitted and the refund policy as mentioned will be followed. › Cancellation can be done during waiting list phase.› Once Work begins, refunds are not possible unless initiated by the Artist.› If for any unforeseen reason I cannot complete the Work or the Work is significantly delayed by 6 months (Paypal's buyer protection limit) I will take initiative to inform you and provide a partial refund if Work done up to this point is accepted or full refund.
